Electronic Signature Law of the People's Republic of China

The Electronic Signature Law of the People’s Republic of China, published in 2005 and amended in 2015 (“E-signature Law”), provides legal recourse to govern the legitimacy of electronic legal instruments.

E-signature can now be used while signing most types of contracts or documents & certificates for civil undertakings except in the following types of documents:

  • those involving marriage, adoption, inheritance and other personal relations;
  • those involving transfer of any rights or interests in land, premises or other immovable property;
  • those involving stopping services such as water supply, heat supply, gas supply, electricity supply or any other public utility services; and
  • other circumstances where electronic documentation is inapplicable as provided by any laws or administrative regulations.
