How is the labor arbitration process in China?

The labor arbitration process in China consists of  four phases. First, the employer and employee are encouraged to sort out the matter on their own out of court. Should this fail, both parties might seek to mediate through the help of the Labor Dispute Arbitration Committee. If either party is dissatisfied, the committee can then move to the next phase, an arbitration hearing, which is legally binding upon the parties and can be enforced through the courts. If none of the above procedures successfully settle the dispute, then the two parties can take the matter to court.
