Trademark Strategy for China Expansion: Anchoring Brand Protection in Hong Kong

Secured trademark protection in Hong Kong while managing complex Chinese Mainland filings

A European premium lifestyle brand preparing to expand into Greater China faced trademark risks after its brand gained visibility among Chinese Mainland consumers before a coordinated filing strategy had been implemented.

Dezan Shira & Associates was engaged to evaluate the registrability of the company’s original European-language brand and design a protection strategy across the Chinese Mainland and Hong Kong. The objective was to preserve brand continuity while securing enforceable trademark rights in a highly competitive filing environment.

Challenge

Trademark clearance searches in the Chinese Mainland revealed a challenging landscape. Multiple similar marks, including phonetic and conceptual variations of the original brand, had already been registered or preliminarily approved in relevant classes. This created a high likelihood that the original-language mark would face refusal based on prior rights.

At the same time, no Chinese-character version of the brand had been secured. Without a registrable Chinese equivalent, the company risked losing control of how its brand would be represented in the market.

The company wished to maintain brand continuity rather than adopt an entirely new identity. However, securing the original mark would require complex administrative proceedings, including oppositions and invalidations against conflicting registrations, each involving extended statutory timelines under Chinese Mainland trademark procedures.

Solution

We designed a coordinated strategy addressing both immediate brand protection and long-term rights consolidation across Greater China.

First, we developed a phonetically aligned and commercially suitable Chinese-character trademark and filed it promptly in key classes in the Chinese Mainland. This created a registrable and enforceable brand asset while longer-term proceedings were pursued for the original mark. The Chinese-character trademark was subsequently granted registration.

Second, we initiated administrative actions against conflicting marks. Opposition proceedings were filed against preliminarily approved trademarks and were successfully upheld. In parallel, invalidation proceedings were launched against earlier registrations, while review procedures for the original-language mark continue as part of a longer-term consolidation strategy.

Third, we secured trademark registrations in Hong Kong for both the original European-language mark and the Chinese-character equivalent. Because Hong Kong operates under an independent trademark system, these registrations were granted without objection.

Impact

Through this coordinated approach, the company successfully entered the Chinese Mainland market using a registered Chinese-character trademark while continuing to pursue protection for the original-language mark.

Trademark rights for the original brand were fully secured in Hong Kong, providing the company with a stable legal position within Greater China. Conflicting preliminary filings in the Mainland were neutralized through opposition proceedings, and ongoing invalidation actions continue to strengthen the company’s rights position.

Most importantly, the strategy allowed the company to maintain brand consistency across jurisdictions while avoiding fragmentation of its brand identity.

Strategic significance and key takeaways

This case highlights the strategic role Hong Kong can play within a broader Greater China trademark strategy. Where Mainland trademark filings face prior registrations and lengthy administrative procedures, Hong Kong can serve as a stabilizing jurisdiction for brand protection.

Key takeaways

  • Trademark filings in the Chinese Mainland can be affected by prior registrations and procedural timelines
  • Developing a Chinese-language brand equivalent can protect market positioning

Streamline ReportingHong Kong’s independent trademark regime can play a strategic role when Mainland filings face delays or prior rights conflicts. Securing protection there gave the client a stable legal foothold in Greater China while Mainland proceedings progressed. Businesses should view Hong Kong not simply as an additional filing location, but as part of a broader regional trademark protection strategy.

Streamline ReportingWhen a brand gains attention in the Chinese Mainland before filings are secured, conflicting trademarks can emerge quickly. In this case, developing and registering a Chinese-character brand allowed the client to enter the market while longer administrative proceedings for the original mark continued.
